Technical Support to the Jordan Civil Aviation Regulatory Commission

BACKGROUND

–              Beneficiary Country: The Hashemite Kingdom of Jordan

–              Contracting Authority: EU Delegation, on behalf of the Ministry of Planning and International Cooperation (MoPIC)

The ENP offered the neighbouring countries, Jordan included, privileged relationship, building upon a mutual commitment to common values (democracy and human rights, rule of law, good governance, market economy principles and sustainable development).

A central element of the European Neighbourhood Policy is the bilateral ENP Action Plans agreed between the EC and each partner. These set out an agenda of political, economic and sector reforms with short and medium-term priorities. Taking into account the development of the Association Agreement, as well as the national reform agendas; Jordan signed a joint Action Plan (AP) with the EC on January 2005. The Plan defined the way ahead over the next five years and tackled several key areas.

In order to benefit from the EC Jordan Association Agreement and Action Plan, three decentralised programmes have been designed, and a specific office, the Programme Administration Office (PAO) has been established in the Ministry of Planning and International Cooperation to implement such programmes.

As part of the support to research and regional integration, it was decided to contribute to the Jordanian reform initiatives in the aviation sector.

The Hashemite Kingdom of Jordan has been giving special attention to the country’s aviation sector. Restructuring the Civil Aviation Authority (CAA) and the adoption of a gradual opening of skies are only examples of the developments happening in Jordan.

With the support of the European Commission, the Hashemite Kingdom of Jordan entered into a five and a half year agreement with Lufthansa Consulting GmbH to provide the CAA, and its legal successor, the Civil Aviation Regulatory Commission (CARC) with technical assistance to strengthen its institutional capacity, support its restructuring, including privatization of various elements of the CARC, and to assist the CARC to effectively regulate the civil aviation sector. The project that has come to an end in December 2009; has succeeded in the restructuring of the CAA into a regulator (CARC), aviation training services private company (Queen Noor Civil Aviation Technical College), Airports Services (Jordan Airports Company), while the last step of the separation of the Air Navigation Services is in process. In addition to that, the project assisted in developing the capacity of the CARC to regulate and oversee the sector and to harmonize its regulations with European standards. New regulations have been developed for technical and economic areas, while some of the regulations remain to be updated, the others were harmonized with EC regulations but they remain at different phases of implementation, some of which are even still pending ratification.

Jordan envisions the Civil Aviation sector as a liberalized sector, with CARC at the helm of that sector to ensure safe and secure skies for all operators. The Civil Aviation Sector in Jordan needs to continue with the reform that has started more than five years back. The new Civil Aviation Law that was passed in 2007 paved the way for the restructuring of the Civil Aviation Authority into a regulator and independent operators. Jordan’s decision to gradually liberalize the industry and harmonize with the European regulation is already underway. With many regulations already changed, it is during the coming months that the implementation of these regulations will have to take place.

As part of the EuroMed Aviation programme, a Road Map for the implementation of the Euro-Mediterranean Common Aviation Area (EMCAA) has been developed, covering the five technical domains of civil aviation: air transport, aviation safety, aviation security, environmental friendliness and air traffic management. Jordan has agreed to an Action Plan (2010-2015) to achieve the objectives indicated in the Road Map.

More over Jordan has signed on the 15th of December the comprehensive agreement with the European Union and its Member States, and it became obligation to harmonize Jordanian aviation regulation with the EU requirements.

Further support to CARC is needed to further strengthen the regulatory aspects within CARC; CARC will develop in essential domains in order to meet EC and international standards. It has been concluded that CARC is a good candidate for twinning with a European counterpart during second half of 2011.

DESCRIPTION OF THE ASSIGNMENT

Global objective:

The global objective of this project is to strengthen CARC’s regulatory and oversight capacity and provide technical support to CARC in order to meet certain requirements and legislation in the aviation sector according to EC best practices.

Specific objectives:

Draft/Update aviation safety and economic regulations in accordance with ICAO annex’s, and harmonize with European Regulations.

Draft CARC Jordan Aviation Industry Databank specifications.

Draft CARC twinning fiche.

Requested services:

Below are the tasks to be implemented by the Framework Contractor. Number of man-days stated per activity is indicative and may be adjusted during implementation of the assignment in the project’s interest.

Draft/Update aviation safety and economic regulations in accordance with ICAO annex’s, and harmonize with European Regulations:

Review and update the drafted Air Navigation Services Regulations.(15 working days)

To draft the Information System and Business Specifications of the Jordan Aviation Industry Data bank that could be used by CARC, particularly in a later tendering process to acquire the services of external solutions developers and providers

Draft CARC twinning fiche. (15 working days)

To draft a twinning fiche according to the EC rules; this fiche shall build the Institutional support to CARC that will help CARC in fulfilling its obligations under the comprehensive agreement and in the above mentioned Action Plan.

This is a list of user requirements as identified by meetings or work sessions with internal and external users, with an identification of the level of importance of the requirements.

Prepared Data Bank Information system specifications:

This will be a document of Information system specifications covering the business and technical specifications of the solution. This would form the basis for CARC’s supply tender procedure for the development and deployment of the databank

Draft CARC twinning fiche in accordance with the prepared twining fiche concept paper.

EXPERTS PROFILE

Air navigation services expert/Team Leader (Senior): To draft air navigation services regulations and twining fiche, while ensuring the proper coordination and performance of the whole assignment. (50 working days)

Relevant education and certification in the aviation sector.

Air navigation inspector with a minimum of 15 years of Experience, including drafting regulations related to air navigation services.

Demonstrated experience and management skills in preparing twining fiche would be an advantage.

Skills and proven track record in air navigation training.

Demonstrated experience and management skills of at least one similar project, additional to previous experience in project documents preparations.

English language proficiency.

Airworthiness Expert (Senior): To draft Part -147 Training Organizations Approval Regulations and Part – 66 Certifying Staff Regulations. (10 working days)

Relevant education and certification in aviation sector.

Airworthiness inspector with a minimum of 10 years of experience, including drafting regulations related to airworthiness regulations.

Skills and proven track record in Airworthiness training.

Demonstrated experience in previous relevant projects.

English language proficiency.

Flight operations Expert(Senior) : To draft JAR-FCL 4 & JAR-FSTD H. (10 working days)

Relevant education and certification in aviation sector.

Flight operations inspector with a minimum of 10 years of experience, including drafting regulations related to flight operations regulations.

Skills and proven track record in flight operations training.

Demonstrated experience in previous relevant projects.

English language proficiency.

Economic expert (Senior): To review/ update airport economic regulation, and to draft air navigation economic regulations and SLOT Management directives. (15 working days)

Relevant education and certification in aviation sector.

Minimum of 10 years of experience in similar fields; including drafting regulations related to aviation economic regulations.

Skills and proven track record in aviation economic training

Demonstrated experience in previous relevant projects.

English language proficiency.

Data bank expert (Senior): To draft Jordan Aviation Industry Databank business and technical specifications. (20 working days)

Relevant education and certification in aviation sector, particularly in aviation systems and databank design.

Minimum of 10 years of experience in similar fields.

Demonstrated experience in previous relevant projects.

English language proficiency.

LOCATION AND DURATION

Starting period: The assignment shall start on 4th  September 2011 and will be finished  by the end of December 2011

Foreseen finishing period or duration: Duration would be 4 months .

Planning including the period for notification for placement of the staff as per art 16.4 a: within 15 days of the signature of the contract; the Team Leader will develop an inception report with a detailed work plan for the implementation of all required activities to achieve the requested outputs.

Working days: Jordan working days are Sunday-Thursday.

Working hours: CARC working hours are 08:00-15:00

TOR designated working days: means working days conducted at Amman, working with CARC staff, no home base working days.

Location(s) of assignment: Amman Jordan.

REPORTING

Content

The Team leader shall report to the CARC Chief Commissioner on progress of the task and shall advise him immediately of any issues encountered.

An Inception Report will be drafted by the expert and submitted two weeks after the beginning of the assignment, including a work plan for the implementation of all required activities.

Brief Progress Reports of a maximum of 5 pages will be drafted on monthly basis by the Technical Coordinator and submitted to the PAO and the EC (electronic copy only).

A Draft Final Report will be discussed by the expert with the PAO at least two weeks before the schedule of the assignment. The final report will summarise the work done, describing in details all activities performed during the contract execution, final conclusion and eventual recommendations for the future.

Language: English

Submission/comments timing: Final approval of all reports is contingent upon acceptance of the services delivered, by CARC, the EU Delegation in Amman and the Programme Administration Office at the Ministry of Planning and International Cooperation.

Number of report(s) copies

Three hard copies and electronic versions of the Inception Report and the Final Report should be delivered to Programme Administration Office at the Ministry of Planning and International Co-operation, the EU Delegation in Amman and CARC.

An electrical version only of the monthly Progress Reports should be distributed to Programme Administration Office at the Ministry of Planning and International Co-operation, the EU Delegation in Amman and CARC.

6. ADMINISTRATIVE INFORMATION

Office space will be provided by the Civil Aviation Regulatory Commission.

The experts should be adequately equipped with necessary personal computer and communication facilities.

Specialised officers in the CARC will provide the expert with all necessary information and date concerning the targeted Beneficiary Organisation – and necessary in order to guarantee a smooth implementation of the foreseen activities. The MoPIC/PAO together with the counterparts will co-operate with the expert and facilitate their assignment to the greatest extent possible.

Reimbursable expenses: a maximum budget line of EU 2000 is made available for translation and interpretation services as needed.

Submission of offers

The Framework Contractor will submit as an integral part of its offer a methodology, the allocation of tasks between the experts, and an indicative timeline for the planned activities based on these Terms of Reference.
